Back in 1972, legislators sought to pass a civil rights law that protected women against sex-based discrimination, and provided for equal opportunities in sports and education. The results of their efforts led to the passage of Title IX of the Education Amendments of 1972, whose original 37 words read as follows:
"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."
Emphasis on the basis of this discrimination: sex. In 1972, legislators were not imagining the seemingly-infinite number of LGBTQQIP2SAA+ "gender identities," "sexual orientations," and "romantic orientations" produced by post-modern minds.
When they sought to protect the scholastic opportunities of women afforded by equal access to competitive sports, classrooms, facilities, and scholarships, they had in mind sex as biologically, historically, and immutably understood: male and female. Not as agender, androgynous, bigender, cisgender, gender fluid, gender questioning, nonbinary, transgender, or whatever new identification subjectively captures the linguistic imagination.
The reasons in science and nature make it clear. Whether accounting for muscular and skeletal density, or heart and lungs capacity, or many other demonstrable scientific facts, our biological capabilities are clearly distinct between the two biological sexes that formulate our species.
Unfortunately, the Biden administration is planning to ignore the science, and advance a sexual cultural revolution that erases the definition and distinction of women and their protections in Title IX. Biden's Department of Education is attempting to redefine "sex" to instead mean “sex stereotypes, sex-related characteristics (including intersex traits), pregnancy or related conditions, sexual orientation, and gender identity.” That is clearly not what Title IX intended, especially when it deprives women of the fairness it sought to afford. As the Heritage Foundation rightly notes, the consequences of such an act:
- "Deprives women of privacy and safety.
- Destroys women's sports by allowing biological men to compete
- Harms childhood development by redefining sex and gender.
- Negatively impacts educational and career opportunities for women.
- And much, much more."
For over 50 years, Title IX has helped young women access fair and competitive sports, safe and private facilities, and educational and financial opportunities. Maybe you were even one of them!

Already, over 130,000 public comments have been submitted, forcing the administration to withdraw two rules because of the overwhelming public pressure against redefining womanhood, endangering children, and undermining religious liberty.
