Supreme Court Ruling Allows Texas Heartbeat Law to Remain in Effect

December 13, 2021 – Raleigh, NC – “We believe it’s time for the law to catch up with the science. We celebrate that the Texas Heartbeat Act will remain in effect, saving the lives of unborn children and protecting mothers while litigation continues in the lower courts. ” stated Tami L. Fitzgerald, Executive Director, NC Values Coalition (www.ncvalues.org).

The Supreme Court ruled today that a lawsuit by abortion providers against Texas over its law banning abortion after a heartbeat is detected may proceed, despite arguments by Texas that the way the law was written made it so that parties could not sue against the law until it was enforced.

"The Court concluded that the petitioners may pursue a pre-enforcement challenge against certain of the named defendants but not others," the court, led by Justice Neil Gorsuch, said. Fitzgerald added, “The ruling is procedural and will not be the final word on the law's constitutionality.”

Fitzgerald continued, “We await anxiously the Court’s ultimate decision in this case and the Dobbs case from Mississippi where the Court has the opportunity to protect unborn children and mothers prior to viability.
